Subject: 2000 West

Since our last meeting 31 July 2003 with you and councilman Keith Corry, we have discussed several options. After conferring with Robert Hall and Kevin Kofford, we have determined the 2000 West right-of-way road value is 200 K per acre. The Smith family as a group has agreed that 150 K in cash plus a 50 K dollar voucher for impact fees with property access rights to each parcel of real estate would be acceptable. We also want the right to transfer the vouchers between the seven of us at our discretion.

We understand that Lewis Robinson's property on the west of and fronting on Proctor Lane has sold for 165 K173 K per acre; and property on the east side of Proctor Lane (13th West) has been contracted for sale at 185 K per acre. Dennis Baker assesses the property at 230 K. We believe, therefore, that the amount we are willing to settle for is fair market value.

On 20 Sept 2003, our representative had separate conversations with Dean Blackhurst and Ronald Anderson regarding the Lindon road between Geneva Road, Proctor Lane (13th west) and Pleasant Grove Boulevard. Our understanding is that there is disagreement and/or lack of cooperation on access rights with Lindon City and Pleasant Grove City. The Lindon City Manager, Ott Dameron, has not been cooperative with Blackhurst and Anderson. Being aware of this information, we therefore insist on maintaining our access rights with 32 foot rightin/ right- out accesses to individual Smith properties.

Our representative had conversations with Dennis Baker. Mr. Baker informed the representative that Pleasant Grove City and Lindon City officials have been told that the value of the Baker land is 230 K per acre. Mr. Baker also indicated a willingness to negotiate a mutually acceptable solution with the city.

We believe our offer is fair and reasonable with a combination of cash, vouchers, and guaranteed property access rights to each parcel of property. This of course would be contingent on maintaining 2000 West access rights as well as written confirmation that the vouchers would be transferable among the seven members of the Smith family.
